Terms and Conditions

These Master Terms and Conditions ("Master Terms") describe the company-wide rules and commitments that apply to all applications and services operated by Shomaa Creatives LLP ("Company," "we," "us," or "our"), a limited liability partnership registered under the laws of India with its principal place of business in Hyderabad, Telangana, India.

Each Shomaa application also has its own dedicated Terms and Conditions that supplement these Master Terms. In the event of a conflict between these Master Terms and an application-level Terms document, the application-level document prevails for matters specific to that application.

1. The Shomaa Product Family

Shomaa Creatives LLP currently operates the following applications:

1.1 ArtfulYo

An arts and events discovery platform connecting artists, ArtLovers, venues, and event organizers, including the companion feature Open Mic by ArtfulYo.

1.2 PollPrint

A standalone polling and opinion platform where users participate in polls, view results, and — as Pollsters — post comments and contribute demographic context to research partnerships.

1.3 Future Applications

Shomaa Creatives LLP may launch additional applications in the future. Each will have its own dedicated Terms and Privacy Policy published at shomaa.org/legal before or at launch. Existing users will be notified of new additions to the product family.

2. Company-Wide Eligibility

All Shomaa applications are strictly for users who are 18 years of age or older. By using any Shomaa application, you represent and warrant that you meet this requirement. We reserve the right to terminate any account we reasonably believe belongs to a user under 18, without prior notice.

3. Separate Accounts Per Application

Creating an account on one Shomaa application does not automatically create an account on any other Shomaa application. Each application maintains independent user accounts, data stores, and login credentials. Data from one application is not transferred to or used by another Shomaa application without explicit disclosure and your consent.

4. Company-Wide Conduct Standards

Across all Shomaa applications, you agree not to:

Use any Shomaa application for unlawful purposes or in violation of applicable law;
Harass, threaten, or abuse other users on any Shomaa platform;
Attempt unauthorized access to any Shomaa application, account, or system;
Upload malware, viruses, or malicious code to any Shomaa application;
Impersonate any person, entity, or organization;
Use any Shomaa application to develop a competing product or service;
Engage in any activity that disrupts or interferes with Shomaa applications or infrastructure.

5. Intellectual Property

All intellectual property rights across Shomaa applications — including software, design, graphics, trademarks, and content created by us — are owned by or licensed to Shomaa Creatives LLP. The following are trademarks of Shomaa Creatives LLP: "Shomaa," "ArtfulYo," "Open Mic by ArtfulYo," "ArtfulEvents," "ArtfulProjects," "ArtLover," "ArtRunner," "StarRunner," "PollPrint," and "Pollster." Unauthorized use of any Shomaa trademark is strictly prohibited.

6. Disclaimers and Limitation of Liability

ALL SHOMAA APPLICATIONS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SHOMAA CREATIVES LLP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF INR 5,000 OR THE TOTAL FEES YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

7. Governing Law and Dispute Resolution

All Shomaa applications are governed by the laws of India, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023. Disputes shall be subject to 30 days of good-faith negotiation, followed by binding arbitration in Hyderabad, Telangana, India under the Arbitration and Conciliation Act, 1996, conducted in English. Mandatory local consumer and data protection rights are not affected by this choice of law.

8. International Users

Shomaa applications are operated from India and available globally. By using any Shomaa application from outside India, you acknowledge that your data may be processed in India; that you are responsible for compliance with local law; and that mandatory local rights are not waived by these Terms. To exercise data rights under local law, contact privacy@shomaa.org.

8.1 California (CCPA/CPRA)

California residents may request to know, delete, and opt out of the sale of personal information. We do not sell personal information. No discrimination for exercising these rights.

8.2 EU and UK (GDPR / UK GDPR)

EU and UK users have rights to access, correct, delete, port, restrict, and object to personal data processing, and to lodge complaints with their local supervisory authority.

8.3 Australia

Australian users may access and correct personal information and lodge complaints with the OAIC at oaic.gov.au.

9. Changes to These Master Terms

We may update these Master Terms from time to time. We will notify you of material changes via email or in-app notice at least 14 days before they take effect. Continued use of any Shomaa application after the effective date constitutes acceptance of the revised Terms.
